All photographs and products sold or displayed through this website, (“Site”),
are the property of Elite Sports Photography, LLC, (“Elite”). U.S. and
international copyright laws protect our products and photographs. Any
unauthorized resale, duplication, modification, transmission, display or any
other reproduction of any of the photographs from Elite subject those parties
responsible to prosecution for violation of U.S. and international copyright
laws. It is understood that a print, not the copyright, is being purchased from
Elite. We maintain all copyrights to all photographs unless our expressed
written consent is given.

Intellectual
Copyrights:
The ideas, designs, collages and other materials and works of are included in
our site are the intellectual property of and copyrighted by Elite Sports Photography, LLC. We reserve the rights available to us under international, federal,
state and local laws to enforce our rights to claim to these designs as
copyrighted and collect damages from any business, organization or persons(s)
that infringe upon or violate our rights.
Privacy
Policy:
We realize that customers are concerned about how the information they provide
online will be used. We are committed to protecting your privacy and will use
the information we collect about you to process your order and provide a more
personalized shopping experience. The information provided to Elite will not be
sold, rented or provided to anyone for any reason without your expressed written
authorization to do so. We are in the business of selling sports photographs and
not information. You have our promise!
Web hosting
services:
We maintain our site through the web hosting facilities at Project A in Ashland,
OR. Elite has no direct control over our hosting facility and occasionally
problems with connectivity may occur. We appreciate your patience and
understanding should our site go down for any reason. The security of the web
host server is maintained by Project A and any responsibilities arising out of
such security do not transfer to Elite.
Payment
Options:
We currently accept payment through Pay Pal, personal check, money order or
cashiers check. All payments must be made out to Elite 1 Imaging.
Please include a copy of your order form with all payments. You can mail the
order form with payment or email the order form if using Pay Pal. An email
notification will be sent on all orders with email addresses listed. If an email
address is not provided, you will not receive notification of your payment
confirmation. Once Elite receives confirmation of payment, orders will be
processed and shipped out within 3-5 business days. Please allow up to14
business days to receive your order. All orders will be mailed out via US Postal
Service to the address listed on your order form. Elite agrees to mail your
order to the address provided on your order form by regular mail, unless other
arrangements are made and prepaid by the buyer. Shipping is only within the
continental United States.
Insurance
Replacement Services:
In the unfortunate event that your photographs are destroyed by water or fire
damage to your home, we will replace at no cost to you, any photographs
purchased from Elite. Replacement will be done on a like, kind and quality basis
of the products originally ordered. This replacement service will only be done
through your insurance company and its authorized representatives. We reserve
the right to request any proof of loss needed to verify your loss. The total
amount of replacement product costs including shipping shall not exceed $500 USD
at current Elite retail pricing. Once we replace your photographs, we are
subrogated to the rights of reimbursement to any liable parties that may have
caused or contributed in any way to your loss.
Limitation
on Liability:
TO THE FULLEST EXTENT ALLOWED BY LAW, NEITHER ELITE NOR ITS DIRECTORS, OFFICERS,
SHAREHOLDERS OR EMPLOYEES ARE LIABLE FOR ANY LOSS OR DAMAGE WHATSOEVER THAT
RESULT FROM USE OF THIS SITE, INCLUDING BUT NOT LIMITED TO: (A) ANY DIRECT,
INDIRECT, SPECIAL, CONSEQUENTIAL, PUNITIVE OR INCIDENTAL DAMAGES; (B) DAMAGES
FOR LOSS OF USE, PROFITS, DATA, OR OTHER INTANGIBLES; (C) DAMAGES FOR
UNAUTHORIZED USE, NON-PERFORMANCE OF SITE, ERRORS OR OMISSIONS; (D) DAMAGES
RELATED TO DOWNLOADING INFORMATION, POSTING INFORMATION OR SENDING OR RECEIVING
E-MAILS; AND (E) DAMAGES RESULTING FROM VIRUSES, WORMS, TROJAN HORSES, OR OTHER
CONTAMINATION OR DESTRUCTIVE PROGRAMS. ELITE’S LIABILITY SHALL BE LIMITED TO THE
GREATER OF TWO HUNDRED FIFTY UNITED STATES DOLLARS OR THE FULL REIMBURSEMENT OF
YOUR ORDER IN ANY JURISDICTION THAT DOES NOT ALLOW THE EXCLUSION OR LIMITATION
OF CERTAIN WARRANTIES OR LIABILITIES.
Third Party
Liability:
Elite uses third party vendors to perform tasks related to our business.
Although we employ the services of these vendors, any and all legal liability
that local, state, federal and international laws require of them do not
transfer or shift the economic, non-economic or punitive damage burden to Elite
by virtue of our use agreements. We hold in trust that these companies are
abiding by all the laws that govern their particular actions in the course of
conducting their business and we will be held harmless for any liability on
their behalf.
